Terms of Service

These Terms of Service ("Terms") govern your use of the WhereYat mobile application ("App") operated by MacWitt Ventures ("we," "our," or "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. We reserve the right to terminate access for any user we have reason to believe is under 18.

2. Description of Service

WhereYat allows users to voluntarily share their real-time location with other users of their choosing for a defined, limited duration. Location sharing is session-based, expires automatically, and can be stopped by the sharer at any time.

3. User Responsibilities

You are solely responsible for:

• Choosing with whom you share your location
• Ensuring that recipients of your location have consented to receive it
• Any consequences arising from how you use the App

You agree not to use the App to:

• Stalk, harass, monitor, or track any person without their explicit consent
• Violate any applicable law or regulation
• Infringe the rights of any third party
• Transmit false, misleading, or harmful information

4. Location Data

Location sharing is initiated voluntarily by you. You control when sharing begins and ends. We do not share your location with any party other than the recipient(s) you designate. Location data is retained only for the duration of your session and deleted automatically thereafter. See our Privacy Policy for full details.

5. No Guarantee of Accuracy

Location data is provided by your device's GPS hardware and may not always be precise. We make no warranty regarding the accuracy, timeliness, or reliability of location information displayed in the App. Do not rely solely on the App for safety-critical decisions.

6. Intellectual Property

The App, including its design, code, and content, is owned by MacWitt Ventures and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10.00, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless MacWitt Ventures from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice. You may stop using the App at any time and delete your account via the Settings screen.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by updating the effective date above. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved in a court of competent jurisdiction.
